Acceptance of Terms

By accessing or using the SpicySpark website (localhost/food-delivery or any live domain), you confirm that you are at least 18 years old and agree to be bound by these Terms & Conditions. If you do not agree to any part of these terms, you must not use our services.

About SpicySpark

SpicySpark is an online food ordering and delivery platform based in Hyderabad, Telangana, India, specialising in authentic Andhra and Hyderabadi cuisine. We facilitate the ordering of food items and arrange delivery to your specified address.

User Accounts

  • You must register an account to place orders. You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to provide accurate, complete, and up-to-date information during registration.
  • You are solely responsible for all activities that occur under your account.
  • Notify us immediately at hello@spicyspark.in if you suspect any unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts that violate these terms.

Placing Orders

  • All orders placed through SpicySpark are subject to availability and confirmation.
  • Prices displayed are inclusive of applicable taxes unless stated otherwise.
  • We reserve the right to refuse or cancel any order at our discretion, including if the item is unavailable, there is an error in pricing, or we suspect fraudulent activity.
  • Delivery is available only within our serviceable areas in Hyderabad. Please check our Delivery Areas page before ordering.
  • Estimated delivery times are indicative and may vary due to traffic, weather, or other factors beyond our control.

Pricing & Payments

  • All prices listed on the website are in Indian Rupees (INR).
  • We accept payments via UPI, credit/debit cards, net banking, and Cash on Delivery (COD) where available.
  • Payment must be completed before order preparation begins (except for COD orders).
  • SpicySpark uses secure, third-party payment gateways. We do not store your payment card details on our servers.
  • Prices are subject to change without prior notice. The price at the time of order placement is the final price.

Cancellations

  • Orders can be cancelled within 5 minutes of placement, before preparation begins.
  • Once the order is being prepared or has been picked up for delivery, cancellation is not possible.
  • To cancel, contact us immediately via phone or WhatsApp at +91 98765 43210.

Food Allergies & Dietary Information

SpicySpark takes food safety seriously. However, our kitchen handles a wide variety of ingredients including nuts, dairy, gluten, and spices. We cannot guarantee that any item is completely free from allergens.

If you have a severe food allergy or dietary requirement, please contact us directly before ordering. SpicySpark shall not be liable for allergic reactions arising from undisclosed or unknown allergens.

Intellectual Property

All content on this website — including the SpicySpark name, logo, design, text, images, and menu — is the intellectual property of SpicySpark and is protected under applicable Indian intellectual property laws. You may not reproduce, distribute, or use any content without our express written permission.

Limitation of Liability

SpicySpark shall not be liable for:

  • Any indirect, incidental, or consequential loss or damage arising from the use of our services.
  • Delays caused by circumstances beyond our reasonable control (traffic, weather, strikes, etc.).
  • Loss of data or unauthorised access resulting from your failure to keep login credentials secure.

Our maximum liability in any case shall be limited to the value of the order in question.

Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.

Changes to Terms

We reserve the right to modify these Terms & Conditions at any time. Changes will be effective immediately upon posting to the website. Continued use of our services after changes constitutes your acceptance of the revised terms.
