Welcome to Spicy Spark. By accessing or using our website or mobile application, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our Service.

1. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding agreement to use our Service. By creating an account, you represent that you meet these requirements.

2. Account Registration

• You must provide accurate and complete information when registering.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Ordering & Payment

• All prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise.
• A minimum order value of ₹100 applies. A delivery charge of ₹40 may apply based on your location.
• Once an order is placed and confirmed, it cannot be cancelled unless the restaurant is unable to fulfil it.
• Payment is processed securely via Razorpay. We accept UPI, credit/debit cards, net banking, and wallets.
• In the event of a failed transaction where your account is debited, refunds will be processed within 5–7 working days.

4. Delivery

• Estimated delivery times are indicative and not guaranteed. Actual times may vary due to traffic, weather, or order volume.
• You are responsible for providing an accurate delivery address. We are not liable for non-delivery due to incorrect addresses.
• Risk of loss or damage to an order transfers to you upon delivery.

5. Refunds & Cancellations

• If your order is cancelled by us (e.g., item unavailability), a full refund will be issued.
• If you receive an incorrect or inedible item, please contact us within 30 minutes of delivery with supporting photos. We will offer a replacement or refund at our discretion.
• Refunds are credited to the original payment method and may take 5–7 business days.
• No refunds will be issued for change of mind after the order has been prepared.

6. Intellectual Property

All content on this Service — including logos, images, text, and software — is the property of Spicy Spark and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

7. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorised access to our systems.
• Submit false, misleading, or fraudulent orders.
• Harass, abuse, or harm our staff, delivery personnel, or other users.
• Use automated tools to scrape or misuse the platform.

8. Limitation of Liability

To the fullest extent permitted by law, Spicy Spark shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or personal injury.

9. Indemnification

You agree to indemnify and hold harmless Spicy Spark, its directors, employees, and agents from any claims, damages, or expenses arising out of your violation of these Terms or misuse of the Service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.

11. Amendments

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes your acceptance.
